These Terms of Service ("Terms") govern your use of theNeedle, including the theNeedle website, waitlist, mobile application, and SMS notification program (collectively, the "Service"), provided by Crescentic LLC ("Crescentic," "we," "us").
Use of the Service
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You agree to use the Service only for lawful purposes and in accordance with these Terms. theNeedle accesses supported mailboxes on a read-only basis and does not send, delete, archive, or modify messages on your behalf.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
SMS Messaging Terms
The following terms apply to the theNeedle transactional SMS notification program operated by Crescentic LLC.
Program description. Crescentic LLC uses theNeedle to send non-marketing SMS account and service notifications to registered subscribers and separately opted-in personal escalation contacts. Subscribers may receive priority-email alerts, account or security notifications (including password, email-address, or mobile-number changes), and service or support notifications. Escalation contacts are trusted people a subscriber chooses to help them maintain personal accountability — not Crescentic employees or operations staff. They receive accountability alerts only after personally accepting an email invitation on a theNeedle acceptance page and providing their own SMS consent; subscribers cannot enroll another person. Messages are triggered by account activity, notification settings, or accepted escalation responsibilities. theNeedle is a product of Crescentic LLC. No promotional, lending, or age-gated content is sent.
Consent. By providing your mobile number, checking the SMS consent box, and selecting Verify and Enable SMS, you agree to receive an SMS verification code and recurring automated transactional SMS notifications from theNeedle, a product of Crescentic LLC. Consent is not a condition of purchase or of using the Service. We retain the mobile number, date and time of consent, consent method, consent-language version, notification scope, and associated account or escalation-contact identifier for each opt-in.
Escalation contacts. A subscriber may invite a trusted person they choose to receive accountability alerts as an escalation contact. The invited person must personally accept the email invitation on a theNeedle acceptance page and verify their own mobile number before any SMS accountability alerts are sent. A subscriber cannot enroll another person on their behalf. Escalation contacts may reply STOP to opt out or HELP for assistance at any time.
Frequency and rates. Message frequency varies. Message and data rates may apply.
Opt-out. Reply STOP to any message to cancel. After you send STOP, we will send an opt-out confirmation and stop sending additional messages unless you voluntarily enroll again.
Help. Reply HELP for help, or contact us using the form on our SMS enrollment page.
Carriers and delivery. Carriers are not liable for delayed or undelivered messages. Delivery may be affected by carrier availability, network conditions, device settings, and other circumstances outside our control. Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, and other major and minor U.S. carriers.
Privacy. Mobile information obtained as part of the SMS consent process, including text messaging originator opt-in data and consent, will not be shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Notice for details.
Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied. theNeedle surfaces information to help you identify potentially consequential communications; it is not legal, financial, tax, or professional advice, and you remain responsible for reviewing and acting on the underlying messages.
Limitation of liability
To the maximum extent permitted by law, Crescentic LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.
Changes
We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date above.
